EPA Storage Tank Enforcement Strategy
The U.S. Environmental Protection Agency has issued a strategy for the enforcement of underground storage tank (UST) regulations. By Dec. 22, 1998, all storage tanks installed before Dec. 22, 1988, that are not protected against corrosion, spills, and overfills must be corrected. EPA has announced that it will not extend the deadline and that violations will result in monetary penalties. Further, there will be no "grace period" in which penalties can be corrected without a penalty.According to the guidance issued by EPA, it will rely on states to monitor and enforce compliance with the UST requirements leading up to the deadline. EPA will, however, work with the states to outreach to UST owners and operators, provide information, and help train UST inspectors.
Operating a UST that is not equipped to protect against corrosion, spills, and overfills after Dec. 22, 1998, will be illegal. EPA has announced that it will not allow substandard tanks to continue in operation after that date and recommends that owners and operators discontinue use of these tanks until they are upgraded, replaced, or permanently closed.
